Order of the People’s Government of Guizhou Province No.205 The Measures of Guizhou Province on Anti-Espionage Security, which were deliberated and adopted at the 102nd Executive Meeting of the People’s Government of Guizhou Province on December 29, 2021, are hereby promulgated and shall come into force as of February 15, 2022.Anti-espionage Security Measures of Guizhou Province Article 1 In order to strengthen and standardize the work of anti-espionage security prevention, fulfill the responsibility of anti-espionage security prevention and safeguard national security,These Measures are formulated in accordance with the National Security Law of the People’s Republic of China, The Anti-Espionage Law of the People’s Republic of China, the Detailed Rules for the Implementation of the Anti-Espionage Law of the People’s Republic of China and other relevant laws and regulations in light of the actual conditions of this province.Article 2 These Measures shall apply to the anti-espionage security work within the administrative area of this province.Article 3 In carrying out the work of security and prevention against espionage, we shall adhere to the unified leadership of the Central committee, the concept of overall state security, the combination of special work with the mass line, the combination of civil air defense, physical defense and technological defense, strictly observe the statutory limits of authority and procedures, respect and protect human rights, and protect the lawful rights and interests of citizens and organizations.Article 4 State security organs at various levels shall, in accordance with their administrative powers, provide professional guidance, supervise, urge and inspect the anti-espionage security work carried out by state organs, public organizations, enterprises, institutions and other social organizations.Article 5 The people’s governments at or above the county level shall strengthen their leadership over the work of anti-espionage security and prevention within their respective administrative areas, study and solve major problems in the work of anti-espionage security and prevention, implement the responsibility system for the work of anti-espionage security and prevention, and ensure the necessary funds for the work.The people’s governments of towns and townships and sub-district offices shall, in accordance with the requirements of the people’s governments at higher levels, strengthen the anti-espionage security work, incorporate the anti-espionage security work into the governance mechanism of “one center, one network and ten joint households”, and guide the village (neighborhood) committees to carry out the anti-espionage security work.Article 6 of the national development and reform, education, science and technology, Ministry of Industry and Information Technology, people, public security, transportation, commerce, culture and tourism, foreign affairs, assets, big data, local financial supervision, and work related to defense department worker, secrecy, Taiwan and other departments shall perform the following anti-spyware safety supervision and management responsibility: (1) clear this system, the field anti-spyware work safety requirements;(2) cooperate with the State security organs in drawing up a list of key units for anti-espionage security in their own systems and fields and carrying out anti-espionage security work;(3) to guide and urge key units in their own systems and fields to fulfill their obligations of anti-espionage security;(4) other responsibilities for supervision and management of anti-espionage security precautions that should be performed.The State security organs shall, together with the relevant departments, establish a cooperative mechanism for anti-espionage security and prevention, so as to achieve information exchange, consultation, collaborative guidance and joint supervision, and jointly do a good job of anti-espionage security and prevention.Article 7 State organs, public organizations, enterprises, institutions and other social organizations shall assume the principal responsibility for their own anti-espionage security work and perform the following obligations of anti-espionage security: (1) Carry out anti-espionage security education and training to improve the security awareness and coping ability of their own personnel;(2) strengthening the anti-espionage security prevention management of the unit and implementing relevant security prevention measures;(3) promptly report to the State security organs suspicious circumstances involving acts of espionage or other acts endangering State security;(4) to properly respond to and handle emergencies of anti-espionage security involving the unit and its personnel;(5) to facilitate or provide other assistance to the State security organs in performing their tasks according to law;(6) other anti-espionage security obligations as prescribed by laws and regulations.Article 8 The State security organs shall, jointly with relevant departments, formulate and regularly adjust the list of key units for anti-espionage security and prevention, and shall inform the key units in written form.In addition to performing the obligations prescribed in Article 7 of these Measures, key units shall also perform the following obligations of anti-espionage security:(2) clarifying that the relevant institutions and personnel of the unit shall assume the duties of anti-espionage security prevention;(3) Strengthen routine security prevention management of secret-related matters, sites, carriers, data, posts and personnel, conduct anti-espionage security prevention review of secret-related personnel before taking up their posts, and sign security prevention commitment letters with secret-related personnel;(4) Organize secret-related and foreign-related personnel to report matters related to national security to the unit, and do a good job in the dynamic management of data and information;(5) to do a good job of anti-espionage security in foreign-related exchanges and cooperation, formulate and implement relevant plans and measures;(6) Do a good job in the pre-departure education, overseas management and interview of the anti-espionage security precautions of the overseas delegations, personnel and long-term overseas personnel of their units;(7) to regularly conduct anti-espionage security education and training for personnel involved in secret and foreign affairs;(8) to equip necessary equipment and facilities and implement relevant technical security measures in accordance with anti-espionage technical security standards;(9) Conduct regular self-inspection of the anti-espionage security work of the unit, discover and eliminate hidden security risks in time.Article 9 Operators of critical information infrastructure shall, in addition to performing the obligations prescribed in Article 7 of these Measures, also perform the following obligations:(2) regularly conducting anti-espionage security education and training for its employees;(3) Take anti-espionage technology security measures to prevent and stop overseas cyber attacks, cyber intrusions, cyber theft and other espionage activities, and ensure the security of network and information core technologies, key infrastructure and information systems and data in important fields.Operators of key information infrastructure listed in the list of key anti-espionage security units shall also perform the obligations prescribed in Article 8 of these Measures.Article 10 Citizens shall fulfill the following obligations of anti-espionage security: (1) Observe relevant laws and regulations concerning anti-espionage security;(2) to provide convenience or other assistance for the State security organs in their anti-espionage work according to law;(3) Promptly report acts of espionage or other acts endangering State security to the State security organ upon discovery;(4) When the State security organ is investigating and learning about espionage or other acts endangering State security and collecting relevant evidence, it shall not conceal, evade or refuse to do so;(5) To keep state secrets related to anti-espionage work that it has come to know;(6) other anti-espionage security obligations that should be performed as prescribed by laws and regulations.If, as a result of assisting anti-espionage work, the personal and property safety of himself or his near relatives is endangered or threatened, he may request the State security organ for protection.The State security organs shall, in conjunction with relevant departments, take protective measures according to law.Article 11 State security organs make comprehensive use of big data, Internet, artificial intelligence, block chain and other technologies to promote the informatization and intelligentization of anti-espionage security and prevention work.Article 12 People’s governments at various levels shall, in light of local realities, organize relevant departments, units and the media to carry out propaganda and education activities concerning anti-espionage security and prevention.People’s governments at all levels shall organize relevant departments to carry out anti-espionage security propaganda and education activities on April 15, national Security Education Day for the whole people, and November 1, the promulgation and implementation day of the Anti-Espionage Law of the People’s Republic of China.Article 13 The State security organs shall, in conjunction with relevant departments and units, formulate annual propaganda, education and training plans for anti-espionage security and prevention, specify the key objects, contents and main forms, and guide them to carry out regular propaganda, education and training.Article 14 The human resources and social security departments shall incorporate anti-espionage and security laws, regulations and knowledge into the continuing education and training of professional and technical personnel.Trade unions, Communist Youth League organizations, women’s federations and other organizations shall, in light of the characteristics of their respective work objects, organize propaganda and education on anti-espionage security and prevention.All relevant departments and units shall, in combination with their respective functions and characteristics of their respective fields, organize and carry out propaganda and education on anti-espionage security and prevention.Article 15 The media such as radio, television, newspapers, magazines and the Internet shall carry out public interest publicity activities on anti-espionage security and prevention, and promptly publish and broadcast public interest advertisements on anti-espionage security and prevention provided by the State security organs.Article 16 Any unit or individual may report suspected acts of espionage and other acts endangering State security, as well as clues of various anti-espionage security problems, through the Telephone number 12339 of the State Security Organs, the online reporting platform of the State Security organs or other reporting methods announced by the State security organs.The State security organ shall strictly safeguard the confidentiality of the informant and protect the personal and property safety of the informant.Without the consent of the informant, the personal information of the informant shall not be disclosed or disclosed in any way.Units and individuals that have made major contributions to preventing or stopping acts of espionage, or have made other major contributions to anti-espionage security work, shall be commended and rewarded in accordance with relevant state and provincial regulations.Article 17 Where state organs, public organizations, enterprises, institutions and other social organizations and their staff fail to perform or perform their duties and obligations for anti-espionage security, thus causing adverse consequences or impacts, the leading personnel and persons directly responsible for the failure shall be dealt with according to law and regulations.Article 18 If the State security organs, relevant departments and their functionaries abuse their power, neglect their duties or engage in malpractices for personal gain in the work of anti-espionage security, the leading personnel who are held responsible and the personnel who are directly responsible shall be dealt with according to rules and disciplines according to law.Article 19 For other acts in violation of the provisions of these Measures, if there are punishment provisions in laws and regulations, such provisions shall
